Applying sanctions due to non-compliance with LGPD [Brazilian GDPR]. Is your company prepared?
This February 27, the National Agency for Data Protection – ANPD published a Resolution that regulates the application of administrative sanctions to those whose actions oppose LGPD – General Law for the Protection of Personal Data. As the Resolution has come into force immediately, fines may already be applied by the Authorities.
All sanctions which have been provided for in the Brazilian LGPD may be applied, ranging from a warning to fines up to R$ 50 million, as well as suspension or prohibition of the company’s data processing activity.
Such sanctions shall be established on the basis of the dosimetry criterion provided for in the referred Resolution.
