The Electronic Labor Domicile (DET) is an online platform created to make communication between companies and labor bodies easier, as provided for in article 628-A of the Consolidation of Labor Laws, as well as decrees No. 10,854/21 and No. 11,905/24, along with MTP Administrative Rule No. 671/21 and MTE Administrative Rule No. 3,869/23.
The DET will be applied to all companies subject to labor inspection, whether or not they have employees, according to article 628-A of the Consolidation of Labor Laws; MPT Administrative Rule No. 671/21, article 140. Its purpose is to make the act of labor inspection less bureaucratic and therefore more agile.
This platform will be made available free of charge by the Ministry of Labor and Employment (MTE) through gov.br.[1], and its functionalities will be implemented gradually.
As of March 1, 2024, its use will be mandatory for companies in eSocial groups 1 and 2 and, as of May 1, 2024, for groups 3 and 4.
Through the DET, the Ministry of Labor and Employment will notify the employer of any: (i) administrative acts; (ii) tax procedures; (iii) subpoenas; (iv) notifications; (v) decisions handed down in administrative litigation; and (vi) notices in general.
It is important for companies to pay attention and register with the DET, as this will be the means by which the MTE (Ministry of Labor and Employment) will make all official communications, including notices of inspections and tax-deficiency notices, as notifications via the official press or by post will no longer exist.
Failure to register and use the platform within the established deadlines will result in administrative fines, as well as subjecting companies to possible missed deadlines in labor inspections and lawsuits.
